“Platform“ or
“nomo”). This Platform allows users to engage in trading activities, including Contracts for Difference (CFDs) on various securities, derivative instruments, copy trading, and investment in diversified portfolios (hereinafter -
“Services”) ー a complete list and comprehensive descriptions of the our Services are available in the
Terms and Conditions, which we encourage you to familiarize yourself with. As part of our commitment to providing a robust and secure environment, nomo offers tools and features that enable users to make informed decisions in their trading journey.
1.3. The Platform has been designed to operate in strict compliance with all applicable legal and regulatory frameworks, ensuring that all interactions are handled in accordance with applicable local and international laws.

This Privacy Policy outlines how and why nomo collects, stores, processes, uses, shares, transfers and retains your personal data (hereinafter - “Policy”) when you interact with our Services — whether through our website, mobile application, or any other online products or services we offer. It also applies when you communicate with us or receive communications from us in any form.

- Visitors refers to individuals who visit and browse the Platform without creating an account or engaging with the Services. - Technical data: Internet Protocol (IP) address; login data; browser type and version; time zone setting and location; browser plug-in types and versions; operating system and platform; other technology on the devices used to access the Services; obtaining personal data from various third parties and public sources, including technical data from analytics providers like Google, advertising networks, and search information providers.
- Communication data: details regarding payments to and from you concerning our Services.

7.1. nomo processes your personal data for several legitimate and necessary purposes to ensure the effective delivery of our Services, maintain Platform security, and comply with applicable legal and regulatory requirements. The specific reasons for using your personal data include:
- to deliver the core services of the Platform;
- to personalize your user experience by tailoring content, recommendations, and Services based on your usage preferences and trading activities;
- to comply with applicable regulations, including AML and KYC requirements, and other legal obligations that help prevent fraud and ensure the security of transactions;
- to conduct identity verification processes and perform any necessary checks to comply with regulatory and legal requirements;
- to process your transactions, including deposits, withdrawals, and trade executions, and manage your account to ensure its proper functioning;
- to provide you with transaction history, reports, and updates on the status of your account, including balances and any relevant changes;
- to monitor and detect unauthorized access or fraudulent activity on the Platform and ensure the safety and security of your account and personal information;
- to protect against data breaches, cybersecurity threats, and other risks to the integrity of the Platform;

8.1. At nomo, we process your personal data in compliance with applicable data protection laws. We ensure that all data processing activities are based on one or more of the following legal grounds:
8.1.1. When you provide us with explicit consent. In certain cases, we may ask for your explicit consent to process your personal data. This may include marketing communications, newsletter subscriptions, or sharing your preferences for personalized services. You can withdraw your consent at any time by contacting us (see Section 18 of this Policy) or by using the opt-out options provided.
8.1.12. To fulfill our contractual obligations with you. 9.1. At nomo, we understand the importance of safeguarding your personal data. However, in certain circumstances, we may share or disclose your personal data in accordance with this Policy. Below are the circumstances under which we may share your personal information:
- with other companies within the Nomo Trade Limited group for operational purposes, including providing, maintaining, and improving our Services;
- with third-party providers that offer Services or products integrated with our Platform, such as providers of communication systems, trading platforms that are essential for your user experience. These third-party providers are obligated to comply with privacy standards and will only use your personal data as necessary to provide their services to us;
- to contracted service providers and advisers who assist us in various business operations, including but not limited to: IT services (e.g., hosting, technical support, and infrastructure maintenance), analytics providers; marketing agencies; financial, regulatory, and compliance consultants. These entities are required to adhere to data protection agreements and are restricted from using your personal data for any purposes other than those for which it was provided;
- with introducing brokers and affiliates who have mutual relationships with us;
- with payment service providers and banks to process deposits, withdrawals, and other financial transactions;
- with auditors and contractors who assist us in auditing our operations, providing business advice, or performing activities related to business management;

9.2. nomo ensures that any third parties with whom we share your personal data are required to handle it with the utmost care and in full compliance with applicable data protection laws. These third parties are bound by strict contractual obligations to use the data only for the specific purposes for which it was provided, ensure the security of your personal data, maintain confidentiality and prevent the data from being disclosed to unauthorized parties, comply with applicable data protection laws and regulations, including ensuring that data is processed lawfully, fairly, and transparently. If any of our service providers fail to meet these standards, we take appropriate action to remedy the situation and ensure continued protection of your personal information.
9.3. In addition our Platform may contain external links to third-party websites. Please note that these external sites are not covered by this Policy. We recommend that you review the privacy policies of any third-party websites you visit, as we are not responsible for their data practices.
10. International transfers
10.1. For data originating in LATAM countries, we take specific steps to ensure compliance with regional regulations and laws, particularly with respect to cross-border data transfers. For example, in Brazil, we adhere to the requirements of the Lei Geral de Proteção de Dados (LGPD), which governs data protection and privacy in the country.
10.2. To ensure legal compliance for cross-border data transfers, we employ several mechanisms, such as:
- Standard Contractual Clauses (SCCs) — legally recognized contractual arrangements that govern the transfer of personal data between entities located in different countries, ensuring that adequate protection is in place for your data. You can request details of these arrangements by contacting us through the provided contact details in Section 18 of this Policy.
- Explicit user consent — in cases where cross-border data transfers require additional user consent, we ensure that users are informed and provide clear, unambiguous consent before any transfer of personal data takes place.
10.3. These measures help us to ensure that data transferred outside of LATAM jurisdictions remains secure and that we comply with local data protection laws, while also maintaining the highest standards of data privacy and user protection.
11. Personal data retention
11.1. nomo is committed to retaining your personal data only for as long as necessary to fulfill the specific purposes for which it was collected, in accordance with applicable laws and regulations. The retention periods may vary depending on the nature of the data and the regulatory requirements that apply to it.
11.2. In compliance with local regulations in LATAM region countries, we observe the following data retention practices:
- In accordance with Brazilian Anti-Money Laundering regulations, we retain data for a minimum of 5 years following the end of the business relationship.
- For compliance with Mexican tax laws, tax-related information is retained for a minimum of 6 years for bookkeeping purposes.
11.3. In certain situations, authorities may require us to retain personal data for longer periods, especially when data is needed for ongoing investigations or legal proceedings. In such cases, we will comply with any lawful instructions issued by the relevant authorities.
11.4. When data is no longer necessary for business or legal purposes, we will either anonymize it or securely delete the records to prevent unauthorized access or use.
11.5. If you have not actively used our financial services for a period of 5 to 6 years (depending on the type of data), we will securely delete or anonymize any personal data that can identify you, unless we can substantiate a legitimate reason for retaining the data for a longer period.
11.6. If an account application is incomplete or rejected, we will retain the data for a period of 6 months, unless applicable regulatory requirements dictate a longer retention period.
11.7. At the expiration of the data retention period, we ensure that your personal data is irrevocably erased by secure destruction methods. Additionally, we will notify any third parties to whom your data was transferred regarding the erasure and request that they implement similar actions to securely destroy or anonymize the data they hold.

If you do not wish to receive marketing communications or have your data shared with third parties for marketing purposes, you can configure your preferences during account creation or via profile settings; when receiving marketing content, you can click the opt‑out link; or you can also email us at support@nomotrade.com to opt out at any time.
- Right to withdraw consent. If the legal basis for processing your data is your consent, you have the right to withdraw that consent at any time. Withdrawing consent will not affect the lawfulness of processing based on consent prior to its withdrawal. Once consent is withdrawn, we will cease processing your data unless the continued processing is required or permitted by law.
- Right to lodge a complaint. If you are dissatisfied with the way we handle your data, or the information you have received, you have the right to lodge a complaint with the relevant data protection supervisory authority. We encourage you to contact us first so that we can address any concerns and improve our practices.
12.2. To exercise any of your rights outlined above, please submit your request via email to
support@nomotrade.com using the registered email address associated with your account. In some cases, we may request additional information to verify your identity.
12.3. We aim to respond to your data requests within 7 business days. However, if your request is particularly complex or involves multiple requests, it may take longer. In such cases, we will notify you of the delay and keep you updated.
12.4. While we aim to handle all requests free of charge, we may charge a reasonable administrative fee for requests that are manifestly unfounded, excessive, or repetitive.
12.5. You as a user from LATAM region countries may have additional rights under local data protection laws:
- In Brazil you have the right to confirm whether or not your data is being processed, request anonymization, and seek an explanation of automated decision-making processes.
- In Mexico you have the right to exercise the ARCO rights (access, rectification, cancellation, and opposition) and limit the use or disclosure of your personal data.
